Reverse doctrine of equivalents ruling reversed in food packaging patent dispute

( January 24, 2025, 19:32 GMT | Official Statement) -- MLex Summary: A decision by Judge Colm Connolly of the District of Delaware to grant Shibuya Hoppmann Corp. judgment as a matter of law of no infringement under the reverse doctrine of equivalents was itself reversed by the US Court of Appeals for the Federal Circuit, which said in a precedential decision that jurors in the case were entitled to credit testimony by an expert for patent owner Steuben Foods. Under the doctrine, infringement liability can be evaded upon showing that a product performs the same or similar function as a patent but in a substantially different way. In the same ruling, the panel — led by Chief Judge Kimberly Moore — upheld the grant of JMOL in favor of Shibuya on a third patent, reversed an order by Connolly which conditionally granted Shibuya a new trial on infringement and vacated and remanded his conditional grants of new trials on invalidity and damages. Steuben’s US Patent Nos. 6,209,591, 6,536,188 and 6,702,985 relate to systems for packaging food products aseptically.See attached document....
