Before a federal judge in Delaware can reach the merits of Realtek’s request for antisuit injunctive relief and claims that Broadcom Inc. and others are engaging in patent holdup, he must first decide whether an analysis of standard essentiality “arises under” patent law — and whether weighing in at all violates principles of international comity.Realtek is accusing Broadcom Inc., or BCI, of engaging in standard essential patent, or SEP, holdup on the heels of lawsuits earlier this year by Avago Technologies International Sales Pte. (Avago Sales) against Tesla at the Unified Patent Court and Munich Regional Court in Germany....
