EU’s carbon border tax fertilizer exemption clarified by EU Commision

( January 8, 2026, 13:00 GMT | Official Statement) -- MLex Summary: Details on an exemption from the EU’s carbon border tax for fertilizer imports were published Thursday by the European Commission. The regulator says the exemption could be triggered under an emergency instrument added to the carbon tax in December if inclusion under CBAM “causes severe harm to the Union internal market due to serious and unforeseen circumstances related to the impact on the prices of goods.” Any exemption would be temporary and retroactive, with carbon tax payments compensated from the date the CBAM entered into force, the regulator says.Q&A document attached....
