US states' can seek discovery about DOJ role in HPE-Juniper deal, judge rules

( December 31, 2025, 21:55 GMT | Official Statement) -- MLex Summary: A federal judge has ruled that states will be permitted some discovery about the actions of the US Department of Justice in permitting the acquisition of Juniper Networks by Hewlett Packard Enterprise. The court is conducting a Tunney Act proceeding to evaluate whether the deal is in the public interest. “[T]he Tunney Act evinces Congress’s recognition that the decision-making process that resulted in a proposed final judgment may be relevant in determining whether the judgment serves the public interest, but primarily to the extent that process bears upon the adequacy of the proposed judgment. Applying this principle, it is apparent that at least some of the discovery the states have requested is appropriate and proportional to the needs of the case,” District Judge P.
