US states move to intervene in DOJ’s HPE-Juniper case
By Flavia Fortes ( October 15, 2025, 13:49 GMT | Insight) -- Twelve states and the District of Columbia have moved to intervene in the Hewlett Packard Enterprise-Juniper Networks merger case, urging a judge in the Northern District of California to conduct a full evidentiary hearing under the Tunney Act to review what they describe as a “tainted” settlement between the companies and the US Department of Justice. The motion argues the proposed consent decree was “the product of undue influence by well-connected lobbyists” and fails to remedy the competitive harms identified by the DOJ’s own complaint and pretrial filings. The states say intervention would also give them an efficient path forward to challenge the merger, should it be necessary.
