They argued that remedies would restore pre-merger levels of competition and insisted the deal must be approved unconditionally. The firms also challenged the methodology used in the technical note that formed the basis for the transaction’s rejection, claiming it lacks empirical results and practical application in Brazil.Plans by Unimed Cascavel — a unit within Unimed, the world’s largest health cooperative — to purchase competitor Hospital Policlínica were rejected by the Brazilian competition authority’s investigative body. But the parties are questioning the watchdog’s reasoning, including a technical note that pointed to competitive risks for customers of hospital and health insurance plans, as well as the market foreclosure for rival hospitals and the decision to block a deal exclusively on the basis of vertical integration....
