Google replies in support of judgment in US case over healthcare site tracking

Google said that the opposition identifies no allegation regarding when any alleged transmissions occurred or when Google purportedly attempted to read any transmissions, and case precedent requires judgment in its favor. “If the expansive discovery completed in this case had turned up evidence that Google actually read the plaintiffs’ communications while in transit, plaintiffs no doubt would have said so in their opposition or sought leave to shore up their pleadings. Instead, plaintiffs advocate for a legal theory unmoored from the court’s holding in ERC and [California Invasion of Privacy Act’s] text and purpose,” it argued. See attached file. ...
