Tundra said the lower court improperly ignored its allegations substantiating that Faire’s brand and retailer customers have “become locked in to Faire’s platform” and “feel compelled to remain,” and therefore that such customers cannot in practice terminate, “even though they increasingly resent Faire’s restrictive policies and would prefer to take some or all of their business elsewhere.”See attached file. ...
