Chinese regulator clarifies integration of outbound data transfers regimes

( February 2, 2026, 04:00 GMT | Official Statement) -- MLex Summary: China’s internet regulator clarified in a new policy briefing that personal-data handlers using standard contracts or certifications to export personal data must file a data export security review if, since Jan. 1, they transmit more than one million non-sensitive or 10,000 sensitive records. During the process, all personal data sent under standard contract or certification protocols will be included among those for security evaluation, and subsequent transfers must align with the assessment outcomes. In addition, data handlers that have registered the Guangdong-Hong Kong-Macao Greater Bay Area outbound contract are required to fulfill obligations such as filing a safety evaluation, finalizing a standard contract or securing outbound certification for transfers outside the region.
