German health insurer faces top court ruling over use of sensitive data

By Sara Brandstätter ( January 7, 2026, 11:33 GMT | Insight) -- Debeka, a private health insurer, will soon face a ruling by Germany’s Federal Administrative Court over whether it may analyze sensitive patient billing and diagnosis data for voluntary preventive care programs without obtaining explicit consent from all insured persons. The appeal, brought by the data protection authority of the state of Rhineland-Palatinate after lower courts ruled in Debeka’s favor, could clarify how the EU's data protection law applies to health data processing for preventive services, and could have broader implications for insurers.Health insurers’ use of sensitive health data without explicit consent will be examined by Germany’s Federal Administrative Court in a case to be heard in February....
