Lawmakers support rehearing in challenge to US FCC data-breach notification rules

Schmitt, Representative Scott Fitzgerald, and 22 other members of Congress told an appeals court that the Federal Communications Commission is seeking to circumvent congressional action through its implementation of updated data-breach notification rules. They argued that the Congressional Review Act prevents an agency from adopting a characteristic part of a rule that was previously disapproved, but that is what the FCC is trying to do in this case.
