Storing staff data from an investigative probe is personal data, EU court opinion says

( September 4, 2025, 12:04 GMT | Official Statement) -- MLex Summary: An organization's investigative department's storage of personal data in an employment file is considered data processing under the EU’s data protection rules, according to an opinion by a senior legal adviser to the EU's highest court. An employer must erase any data from the employee’s personal file relating to a dropped criminal probe, because the status of a person's job — such as being a police officer — isn't reason enough to make it lawful, Advocate General Maciej Szpunar said. Today's opinion stems from a Bulgarian case referred in which a police officer claims his career progression was harmed because his employer kept a record of a dropped criminal probe.The Advocate General opinion is attached.
