French privacy watchdog’s fining rules violate right to remain silent, court says

( August 8, 2025, 16:30 GMT | Official Statement) -- MLex Summary: France's Constitutional Council has said that rules setting out fining procedures for the country's data protection watchdog violate the right to remain silent. The ruling follows appeals by online fortune tellers Cosmospace and Télémaque that were fined 250,000 euros and 150,000 euros respectively by the French Data Protection Authority, for violating the EU's General Data Protection Regulation. The Council said the authority's administrative provisions for its restricted committee that were ruled unconstitutional must be repealed by Oct. 1, 2026. Anyone accused before the restricted committee until the rules are repealed must be informed of their right to remain silent, the court said.The decision in French is attached....
