WhatsApp’s lawyers in the case recommended damages between $52 and $59 million, but a diverse jury tripled that, emphasizing the unpredictability of privacy litigation. As Google prepares for a jury trial in San Francisco, which the dollar-value of privacy is very much at issue, it will have to face that same level of uncertainty about how a group of regular people might value their privacy.
