Data Privacy & Security – Amazon – collective privacy claims – Preliminary court ruling (EU)
A Dutch Court referred five questions in a lawsuit brought by the Dutch non-profit foundation Stichting Data Bescherming Nederland (SDBN) against four Amazon entities to the EU's top court. The Dutch court is asking the EU's highest court to clarify whether privacy groups can seek damages without explicit mandates from individuals. It further wants to know if Dutch national law is allowed to impose additional conditions on interest groups that want to bring collective GDPR claims and if they need to have a proven track record in data protection, according to the GDPR's Article 80(1).
