Data Privacy & Security - Medibank Private - 2022 data breach (Australia)

Personal data of 9.7 million Australian customers of health insurance company Medibank Private have been breached. Some data have been illegally published by ransomware criminals. Class actions have been filed on behalf of Medibank customers with the Federal Court of Australia. The lead applicant in one class action is Zoe McClure and the case carries the Federal Court reference VID64/2023; the lead applicant in the second class action is Cihan Solbudak and the case carries the Federal Court reference VID302/2023. However, the two lawsuit were later merged, with Zoe McClure the lead application. Melbourne-based law firm Maurice Blackburn has joined Bannister Law Class Actions and Centennial Lawyers in filing a complaint to the OAIC, on behalf of affected Medibank customers. The Sydney office of global law firm Quinn Emanuel Urquhart & Sullivan (with Recency VI Funding) has filed a lawsuit on behalf of affected Medibank shareholders to the Supreme Court of Victoria and the case carries the reference ECI 2023 01227. In June 2023, law firm Phi Finney McDonald announced a further lawsuit on behalf of affected Medibank shareholders to the Supreme Court of Victoria and the case carries the reference ECI 2023 02833. Medibank has also launched a lawsuit against the OAIC to shut down the Maurice Blackburn privacy claim, with Federal Court casefile number VID757/2023. OAIC has launched proceedings in the Federal Court against Medibank over failure to take reasonable steps. Federal Court reference: VID497/2024.
