Intellectual Property - Dwango - FC2 - Patent infringement litigation over Dwango's comment-streaming invention (Japan)

Japanese internet media company Dwango is suing FC2, a US-based online video platform for injunction and damages claiming infringement of its patented invention (Japan Patent No. 6526304) to superimpose live user comments on streaming videos. The lower court ruled the use of US-based network servers to reflect FC2's Japanese users' PCs make FC2's "production" of the event outside of Japanese patent protection, which the IP High Court reversed claiming partial components of a network existing abroad doesn't automatically qualify the "production" taking place outside of Japanese borders. FC2 has appealed to the Supreme Court.
