Intellectual property - Motorola - trade secrets - copyright - damages and extraterritoriality in trade secret misappropriation and copyright infringement case
Motorola Solutions and Motorola Solutions Malaysia sued Hytera Communications Corp. over trade secrets and copyrighted code stolen by former Motorola engineers. The US Court of Appeals for the Seventh Circuit upheld the award of damages on behalf of Motorola under the Defend Trade Secrets Act, agreeing that the statute can be applied extraterritorially. An award of damages for Hytera's copyright infringement must be revisited, with the Seventh Circuit finding no foreign damages available to Motorola.
