Antitrust - Misuse of market power - Commerce Act update (New Zealand)
New Zealand's Ministry of Business, Innovation and Employment is reviewing parts of the country's competition law — the Commerce Act — that relate to misuses of market power. Section 36 of the Commerce Act seeks to prevent incumbent companies with market power from abusing that power to suppress competition. In announcing the review, the ministry said Section 36 was "difficult to enforce and it might not be capturing a wide enough range of anticompetitive conduct."
