Antitrust - US FTC - Express Scripts' litigation over interim report on PBMs (US)
Express Scripts filed a complaint against the US Federal Trade Commission over the agency’s interim report on pharmacy benefit managers, saying it's full of unsupported innuendo leveled against it and other PBMs “under a false and defamatory headline and accompanied by a false and defamatory press release.” The company argued that the report followed prejudice and politics, not evidence or sound economics, and wrongly concluded that PBMs inflate drug costs and harm independent pharmacies. Express asks that the report be vacated and corrected and that FTC Chair Lina Khan be recused from further proceedings regarding Express Scripts in light of her “evident bias.”
