Antitrust - Ericsson - Apple's litigation over Frand licensing of wireless technology (US)

Apple filed a US complaint seeking a declaration that Ericsson violated a global agreement to cross license patented standard-essential wireless technologies and its obligation to offer Frand terms for a new license. Apple claimed that Ericsson prematurely filed litigation against it prior to a scheduled renewal of the agreement and after issuing its “sticker price.” “Ericsson sued rather than negotiate in good faith with Apple, because Ericsson is trying to coerce Apple to pay excessive future royalties in breach of Ericsson’s binding FRAND commitments,” Apple said.
