US District Judge Donovan W. Frank did not decide whether the law violated the First Amendment, and instead concluded that xAI failed to establish the immediate, irreparable harm necessary for a preliminary injunction. The public interest strongly favors allowing the law to remain in effect while the constitutional fight proceeds, Frank said. "In the future, the Court may also consider whether xAI is entitled to permanent injunctive relief on the merits," Frank said. "Until then, because xAI has not demonstrated irreparable harm and the balance of harms tips steeply in favor of the State, xAI’s motion for a preliminary injunction is denied."
