The gas stations entered into agreements to outsource their pricing decisions to the algorithmic tool Kalibrate Fuel Pricing, thereby violating the Cartwright Act. The conduct constitutes an unlawful trust—a combination of capital, skill, or acts by two or more persons to fix, control, or establish the price of a commodity, the lawsuit said. "Kalibrate is a driving force behind this new anticompetitive reality.
