California asks US appeals court to allow election communications law to go through

( January 12, 2026, 23:31 GMT | Official Statement) -- MLex Summary: California Attorney General Rob Bonta asked a US appeals court to overturn an inunction against a state law that prohibits materially deceptive election communications, arguing that the law is not preempted by the Communications Decency Act. Bonta said that law remains outside the scope of the CDA because it creates a statutory obligation on all platforms, common-law distributors and publishers alike, and imposing liability on a platform that chooses not to follow the law is not imposing liability on a platform’s own publishing decisions.See attached file. ...
