Office of Disciplinary Counsel of the Supreme Court of Ohio, is precedent that shows the NRF suit must be dismissed. "It is well-settled that Zauderer permits governments to require businesses to make factual and uncontroversial disclosures. Plaintiff, however, merely alleges that § 349-a(2) does not align with its members’ preferred 'brand identity' and 'corporate messaging'. But this self-serving complaint is wholly immaterial under Zauderer," the state said in a brief filed by New York Attorney General Letitia James.See attached document....
