Ups, downs in US Westlaw copyright dispute embody complexity of AI, fair-use issue

The decision last week to allow an interlocutory appeal on two crucial questions comes seven months after the judge assigned to the case undid his own summary judgment, also on the eve of trial. While that could signal yet another change of heart by US Circuit Judge Stephanos Bibas, it's more likely a reflection of how close a call the question of fair use is in the machine-learning context.There will be no trial next month on damages owed by Ross Intelligence to Thomson Reuters for its infringement of a subset of copyrights associated with the Westlaw database....
