South Korea tightens corporate-disclosure enforcement with tougher penalties

( November 3, 2026, 06:03 GMT | Official Statement) -- MLex Summary: South Korea's antitrust regulator will significantly increase penalties for repeated corporate-disclosure violations while eliminating several reductions that previously allowed companies to avoid heavier fines. The Korea Fair Trade Commission said Tuesday that revised rules taking effect Nov. 9 will raise penalties by 10 percent for one previous violation, 30 percent for two and 50 percent for three or more within the preceding five years, replacing a system that imposed a maximum 20 percent increase only after at least four violations. The amendments also eliminate penalty reductions of up to 75 percent for delayed disclosures and a 20 percent discount for first-time offenders or companies without recent violations. The changes, which cover disclosures concerning corporate group information and large-scale internal transactions, also remove a provision capping base penalties for smaller companies at 1 percent of their capital or equity.Statement is attached (in Korean)....
