United Therapeutics wins on appeal against Sandoz's US antitrust claims over Remodulin

The US Court of Appeals for the Third Circuit affirmed the dismissal of Sandoz’s antitrust claims accusing UTC of illegally obstructing the release of a generic competitor to the drug Remodulin. “[T]he record shows that UTC’s procompetitive justifications are sincere, as UTC was consistently concerned about securing a cartridge supply for its own product. There is nothing pretextual about seeking to protect a procompetitive investment and also seizing the opportunity to disadvantage a competitor along the way,” US Circuit Judge L.
