Microsoft wins dismissal of ChatGPT subscribers' US antitrust claims
( September 28, 2026, 17:51 GMT | Official Statement) -- MLex Summary: Plaintiffs accusing Microsoft of restricting OpenAI’s product output and imposing a price floor on OpenAI’s ChatGPT products have not properly alleged an antitrust injury, according to a US federal judge. District Judge P Casey Pitts granted dismissal with leave to amend, saying, “Plaintiffs are not competing compute providers foreclosed from being able to sell compute to OpenAI. Nor are plaintiffs competing [consumer generative AI] providers foreclosed from accessing compute capacity necessary to compete with OpenAI. A contractual constraint inhibiting one competitor’s ability to compete does not amount to an antitrust injury absent a broader harm to the market’s ability to provide consumers a full range of options.” Pitts denied the company’s motion to compel arbitration.
