Contempt improper where doubt exists over injunction order, US DOJ says
( September 21, 2026, 21:34 GMT | Official Statement) -- MLex Summary: The US Department of Justice filed a brief with the US Supreme Court urging it to find that civil contempt is improper if “a fair ground of doubt exists whether the party’s conduct violates the injunction’s terms.” The agency filed the brief in support of neither part in Apple’s challenge to a contempt order in an antitrust case brought by Epic Games. “[T]he court should reverse the contempt finding as to the 27% commission, affirm as to the ‘plain button’ limitation, and vacate and remand for the lower courts to apply the standard to the remaining actions. The injunction’s text banned petitioner only from prohibiting directed off-app purchases, not from imposing a commission on them,” the DOJ said. See brief....
