Sandoz wins dismissal of several Humana state law claims in US drug pricing case

( September 15, 2026, 03:56 GMT | Official Statement) -- MLex Summary: A Pennsylvania federal judge granted in part and denied in part generic drug company Sandoz's motion for summary judgment on Humana's state law claims in antitrust litigation over generic drug prices. US District Judge Cynthia Rufe of the Eastern District of Pennsylvania dismissed Humana's claims under the consumer protection laws of Nevada, the District of Columbia, Michigan, Oregon, Missouri, Massachusetts, and Minnesota, saying those laws do not regulate harm to businesses. She also dismissed Humana’s state law consumer protection claims as to Arkansas, New Mexico and Rhode Island, reasoning that those states' laws do not extend to anticompetitive conduct. See court filing. ...
