Apple urges US Supreme Court to rule against contempt order in Epic's antitrust case
( September 14, 2026, 20:20 GMT | Official Statement) -- MLex Summary: Apple filed a brief urging the US Supreme Court to reject a “spirt-based rule” imposed by the Ninth Circuit to hold it in contempt in its competition dispute with Epic Games. “Instead of ensuring that parties receive clear notice of what is prohibited upfront, the Ninth Circuit’s rule invites a subjective, after-the-fact inquiry in which a party can be held in contempt for conduct that the order does not address. That approach not only fails to afford parties the explicit notice this Court’s precedents require, but it also amplifies the unique risk of abuse threatened by the contempt power,” Apple argued.
