Disney wins arbitration bid in Fubo subscriber US antitrust case
( September 9, 2026, 00:45 GMT | Official Statement) -- MLex Summary: A California federal judge compelled arbitration of individual antitrust claims brought by Fubo subscribers against Disney and dismissed class claims. Plaintiffs Cole Unger and Steven Prescott filed the lawsuit against Disney alleging that the company's carriage agreements inflated the price of their Fubo live-television streaming service subscriptions and restricted the channels available to them through their subscriptions. Disney had argued that when Unger and Prescott signed up for Fubo, they both assented to then-current versions of Fubo's Terms of Service, which included an arbitration agreement as well as a provision requiring claims to be pursued on an individual basis rather than through a class action. In an order, US District Judge Edward Davila wrote that because the terms "are valid and by agreeing to them, Plaintiffs waived their right to litigate claims as part of a class, Plaintiffs' putative class claims are DISMISSED."See attached order....
