xAI can't sue Minnesota over nude deepfake ban on behalf of users, state AG says

( August 19, 2026, 23:13 GMT | Official Statement) -- MLex Summary: A federal lawsuit from xAI challenging the constitutionality of a Minnesota law barring nude deepfake images should be dismissed because the company lacks standing to sue on behalf of users, and the company has no relevant First Amendment interest, Minnesota Attorney General Keith Ellison said in a motion to dismiss. A First Amendment "challenge can succeed only if a substantial number of the law's applications are unconstitutional when judged in relation to its plainly legitimate sweep," Ellison said.
