Windmill Organics loses UK trademark opposition against Venture Foods

The UK Intellectual Property Office ruled that there was no likelihood of consumers being deceived, and that Windmill’s evidence of confusion was only “hearsay.”Windmill Organics, which produces the Biona Organic line of organic food products, has lost its attempt to invalidate the Geo Organics trademark held by rival Venture Foods. Windmill had challenged the Geo Organics trademark on the grounds that the design was too similar to its Biona trademark and was likely to cause confusion, and also claimed Venture’s use of the trademark misled customers into thinking the two products were linked....
