Ninth Circuit says Section 230 can't provide Meta, TikTok immunity from US suit
( August 10, 2026, 19:14 GMT | Official Statement) -- MLex Summary: A federal appeals court has dismissed appeals by Meta Platforms and TikTok for district court rulings about the limits of the companies' legal immunity under Section 230 of the Communications Decency Act, with the US Court of Appeals for the Ninth Circuit saying it lacks jurisdiction to review the lower-court decisions. "Because section 230 merely provides a defense to liability—not immunity from suit—we lack appellate jurisdiction to review the district court’s rulings on an interlocutory basis. Therefore, we dismiss Meta’s and TikTok’s appeals and plaintiffs’ conditional cross-appeals," US Circuit Judge Jacqueline H. Nguyen wrote on behalf of a three-judge panel.See attached order....
