Eli Lilly, Nordisk win dismissal of US antitrust claims over GLP-1 drugs

US District Judge Micaela Alvarez granted a motion to dismiss, finding that Strive cannot plausibly allege that its products are interchangeable with branded GLP-1 medications. “Because compound GLP-1 medications are only available to patients that cannot use branded GLP-1 medications as a matter of medical necessity, they cannot reasonably be understood as an interchangeable substitute for branded GLP-1 medications in the ordinary sense of market competition,” Alvarez said.See attached file. ...
