Iowa, other states say Calif. antitrust law doesn't apply to out-of-state purchases

( July 28, 2026, 22:31 GMT | Official Statement) -- MLex Summary: Iowa led 13 other states in writing to the US Court of Appeals for the Ninth Circuit, urging the court to overturn class certification in antitrust case over Altria Group’s investment in Juul Labs and its effects on competition in the e-cigarette market. The brief argues that the certification order allows “California antitrust law to govern purchases made by Iowans in Iowa.” “Although the order acknowledged that the class includes out-of-state purchases, it did not meaningfully address whether the Cartwright Act governs those transactions. Instead, the district court brushed the issue aside and skipped ahead to the choice-of-law analysis. But the Cartwright Act does not apply extraterritorially to transactions that occur out-of-state,” the states said.See attached file. ...
