The US Court of Appeals for the Third Circuit reversed dismissal, concluding that the lower court did not adequately consider the allegations in plaintiffs’ complaint in context with the “complexity and novelty of dynamic pricing algorithms.” The court said that while there are independent business reasons to use dynamic pricing software, “there are rarely legitimate business justifications for affording competitors the benefit of commercially sensitive proprietary information under the circumstances alleged.”See attached file. ...
