US lawmakers back rehearing of challenge to FCC data-breach notification rules

Schmitt, Representative Scott Fitzgerald, and 22 other members of Congress told an appeals court that the Federal Communication Commission’s updated data-breach notification rules for telecom carriers illegally circumvented congressional action. The lawmakers filed a brief in support of the Court of Appeals for the Sixth Circuit rehearing a court challenge to the decision. They argued that the majority’s rule violates the separation-of-powers benefits of the Congressional Review Act by allowing an agency to reissue the same rule that received a disapproval resolution from Congress and forces Congress to play whack-a-mole with each “new” regulation.See attached file. ...
