Apple defeats CSAM claims as US judge says Section 230 bars complaint

US District Judge Wise said she had no choice but to dismiss the complaint against Apple despite the “profound cruelty” the plaintiffs endured, because in simply making the choice of which content-reporting system to use for such child porn materials, Apple won protection under the legal umbrella of Section 230 because that decision “requires the Court to treat Apple as a publisher” of user generated content.Apple has defeated class-action litigation alleging the company was negligent in its detection of online child pornography, with a federal judge in California ruling that the tech giant was immunized by Section 230 of the Communications Decency Act....
