EU Commission loses German state aid appeal over power cogeneration plants

( July 9, 2026, 09:46 GMT | Official Statement) -- MLex Summary: The European Commission's appeal in a state aid case against Germany over high-efficiency cogeneration plants has been dismissed by the EU's highest court. The commission was challenging an earlier judgment that said it was wrong to classify the German support for the project as state aid. In its ruling, the Court of Justice said that only advantages granted directly or indirectly through state resources could be considered state aid under EU law and ordered the commission to pay Germany's costs from the appeal. The judgment is attached.
