Blue Cross wins dismissal of US claims over spinal fusion treatment

TranS1 claimed that BCBS conspired to keep it out of the market for spinal fusion therapy by refusing to cover its services. “Fundamentally, it is unclear from the Complaint whether the market is for a spinal procedure or for a product used in the procedure.6 TranS1 alleges that it owns all rights to the AxiaLIF procedure and associated medical devices, but it does not appear from the Complaint that TranS1 conducts the procedure,” District Judge Kelley B.
