The Delhi High Court reaffirmed territorial trademark rights and held that global reputation alone cannot substitute for proven Indian goodwill. In a judgment clarifying the boundaries of international trademark protections in domestic markets, an Indian court has barred Irish whiskey maker Robert A. Merry and Co. from selling its products in India under its global brand names “The Whistler” and “Whistler.”...
