Apple files reply in support of US Supreme Court review of Epic Games injunction fight

Apple argued that Epic’s response concedes there is circuit conflict on the contempt issue, and the US Court of Appeals for the Ninth Circuit itself declared that its prior precedent says parties may be held in contempt for violating the spirit of an injunction, directly conflicting with the “text-based standard” applied in other circuits. “Epic argues the district court could have modified the injunction on a going-forward basis to address commissions. But that just underscores the need for review. Civil contempt is a serious sanction with serious consequences.
