Simon said that Oak seeks to use antitrust laws to shield itself from competition and blame an established real estate developer for its inability to close deals with a few prospective tenants. “Plaintiffs complain they have been harmed because competitive pressure from Simon required Oak to offer better terms to tenants than Oak wanted to offer.
