South Korea seeks public comment on draft privacy-fine calculation rules

( June 1, 2026, 04:20 GMT | Official Statement) -- MLex Summary: Proposed amendments to South Korea’s privacy law decree, which establishes detailed criteria for calculating privacy fines under recently revised privacy law, are open to a public consultation. The Personal Information Protection Commission said Monday that the draft decree, which is open for comment from June 1 to July 13, sets out criteria for determining penalties in cases of serious privacy violations. The amendments follow changes to the Personal Information Protection Act that allow fines of up to 10 percent of a company’s total revenue for significant violations. The draft decree specifies factors the watchdog would consider when assessing penalties, including the severity of the violation, the scale of harm and conditions under which fine reductions can apply. The PIPC plans to finalize the amendments before the revised law takes effect on Sept. 11. The draft decree is available on the PIPC’s website.
