US DOJ opposes high court review of Uber security officer's conviction over data breach

( May 26, 2026, 18:47 GMT | Official Statement) -- MLex Summary: The US Department of Justice opposed former Uber security official Joseph Sullivan's petition for US Supreme Court review of his conviction for obstruction and misprision in concealing a 2016 data breach from the Federal Trade Commission. The agency said that although Sullivan is correct that a nexus between a defendant’s obstructive conduct and a governmental proceeding is required, he is incorrect in contending that the issue is presented in the current case. The DOJ argued that the court of appeals accepted that common ground — focusing exclusively on whether the jury instructions adequately conveyed that requirement — and that case-specific determination does not warrant review, particularly because it was correct and because any instructional error would be harmless in any event.See attached file. ...
