Indonesia data protection agency delay challenged at Constitutional Court
( May 8, 2026, 10:48 GMT | Official Statement) -- MLex Summary: Four individuals have filed a constitutional challenge with Indonesia’s Constitutional Court over the absence of an independent personal data protection agency mandated under the country’s 2022 Personal Data Protection Law. In a hearing on Thursday, the petitioners argued that the law does not set a clear deadline for establishing the agency or issuing implementing regulations, creating legal uncertainty and leaving Indonesia without an independent authority to oversee compliance, prevent data breaches and resolve disputes related to misuse of personal data. The Constitutional Court said the petition challenges Articles 58(5) and 61 of the law, seeking a ruling that would require the government to establish the agency and issue implementing regulations within two years of the court’s decision.Statement follows (in Indonesian)....
