US trade court rules against Trump's global tariff under Section 122

( May 7, 2026, 21:58 GMT | Official Statement) -- MLex Summary: The US Court of International Trade ruled against President Donald Trump's 10 percent global tariff under Section 122 of the Trade Act of 1974, ruling for a coalition of 24 Democratic-led states and small businesses. CIT Chief Judge Mark Barnett joined Judge Claire Kelly in ruling against Trump's use of Section 122 in late February to impose the temporary tariff for 150 days. Judge Timothy Stanceu said in a dissenting opinion that the 122 tariffs could stand. Barnett and Kelly said a balance of payments deficit as indicated in the original statute is separate from a trade deficit and refers to a specific economic and monetary crisis. The ruling grants a summary judgment and permanent injunction staying the tariffs and granting relief to Washington state and the small businesses who had standing.See attached....
